As details continue to emerge about Texas shooter, Devin Patrick Kelley, one thing has become clear. Kelley should never have been able to buy the gun he used to kill 26 people and wound 20 more. Tragically he did get the weapon, thanks in no small part to Democrats who opposed important gun safety legislation.

Kelley entered the First Baptist Church in Sutherland Springs, Texas last Sunday, and used an assault rifle to kill innocent worshipers. The investigation has since revealed, that he was court-martialed by the Air Force for violently assaulting his, then, wife and stepson. He also had a significant history of mental instability. So, how exactly did he get the weapons?

Democrats and government incompetence handed them to him.

In 2013, Sen. Ted Cruz and Sen. Chuck Grassley introduced the Grassley-Cruz legislation. An aggressive bill targeting felons and violent criminals to stop them from getting guns. One crucial element of the legislation mandated that federal agencies, including the Air Force, report violent crimes to the National Instant Criminal Background Check System.

“This should have been stopped beforehand,” Cruz told Fox News. “Under federal law, it was illegal for this individual to purchase a firearm. He had a conviction for a crime that is punishable by more than a year in prison, and he had a conviction for multiple domestic violence crimes.”

Preventable Tragedies

However, despite the bill being introduced after the mass shooting at Sandy Hook, Democrats filibustered the legislation. But, that is not the only reason Kelley was able to purchase a gun legally. He purchased the rifle in Colorado by lying on the BAFFTE background check form, saying he had no criminal history.

Unfortunately, while lying on that form is a felony, most people don’t fear prosecution because it rarely happens. According to Senator Cruz, 48,000 felons and fugitives lied to try and illegally purchase guns in 2010. But, not interested in enforcing the law, the Obama administration only prosecuted 44 cases.

Although, the former president was similarly lax about prosecuting illegal immigrants, so that isn’t shocking.

A similar mistake by James Comey’s FBI allowed South Carolina shooter Dylan Roof to buy a gun. The agency runs federal background checks for gun dealers in more than 30 states, including South Carolina. If the agency does not report back to the retailer with a yes or no decision in three business days, U.S. law allows the gun sale.

As usual, it looks like Democrats are pointing fingers in the wrong direction.
